These Terms of Service ("Terms") govern your use of AvatarSim ("we", "us", or "our") AI-powered real estate avatar training platform located at https://avasim.ai ("Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Service Description

AvaSim provides AI-driven video role-play tools that enable real estate professionals to practice client conversations through interactive scenarios with AI avatars.

• AI-powered avatar conversations for sales practice
• Curated real estate scenarios (buyer and seller interactions)
• Real-time coaching tips and performance feedback
• Practice session recording and analysis
• Progress tracking and performance metrics

Target Users: Our Service is designed exclusively for real estate professionals, agents, and sales teams seeking to improve their client conversation skills.

3. Subscription Plans & Billing

Available Plans

Billing Terms

• Payment Processing: All payments are processed securely through Stripe
• Automatic Renewal: Subscriptions renew automatically unless cancelled
• Currency: All prices are in US Dollars (USD)
• Payment Methods: Major credit cards and payment methods supported by Stripe
• Billing Cycle: Monthly subscriptions bill every 30 days; annual subscriptions bill every 365 days
• Price Changes: We will provide 30 days notice for any subscription price changes

Refunds & Cancellations

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of your current billing period
• No refunds are provided for partial billing periods
• No refunds are provided if any practice minutes from your subscription have been used
• Upon cancellation, you lose access to the Service and all accumulated practice minutes
• We reserve the right to terminate accounts for violations of these Terms

4. Minute-Based Usage System

How Minutes Work

• Minimum Session: Each practice session requires a minimum of 1 minute
• Billing Increment: Usage is tracked to the second but billed in whole minutes (rounded up)
• Real-Time Tracking: Your minute balance updates in real-time during practice sessions
• Session Control: You can end practice sessions at any time

Minute Accumulation

Annual Subscription Minutes

Annual subscribers receive monthly minute allocations rather than their entire year's worth upfront:

• Immediate grant of one month's allocation upon purchase
• Additional monthly allocations granted on your billing anniversary
• Same accumulation cap applies (2x monthly allocation)
• Prevents abuse while maintaining fair usage

5. Booster Packs

Available Booster Packs

Booster Pack Terms

• One-time purchases that add minutes to your current balance
• Booster minutes count toward your 2x accumulation cap
• If adding booster minutes exceeds your cap, oldest minutes are replaced
• No refunds on booster pack purchases
• Minimum transaction amount is $10 due to payment processing requirements
• Instant activation upon successful payment

6. Free Trial

Trial Terms

• Duration: 7-day free trial period
• Minutes Included: 10 practice minutes
• No Credit Card Required: Start your trial without payment information
• Full Access: Access to trial scenarios and basic features
• One Trial Per User: Each user is limited to one free trial

Trial Limitations

• Trial users cannot purchase Booster Packs
• Limited access to premium scenarios and features
• Trial expires automatically after 7 days
• No minute rollover or accumulation during trial period
• Must upgrade to paid subscription for continued access

Free Trial: We offer a free trial that doesn't require a credit card. Trial users receive limited access to scenarios and practice minutes.

7. User Accounts & Responsibilities

Account Requirements

• You must be at least 18 years old to create an account
• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• One account per person - sharing accounts is prohibited
• You are responsible for all activity under your account

Account Security

• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized account access
• You are liable for all activities under your account
• We reserve the right to suspend accounts for security reasons

8. Acceptable Use Policy

Permitted Uses

• Professional development and sales training for real estate
• Practice conversations with AI avatars for skill improvement
• Recording practice sessions for personal review and learning
• Using scenarios and coaching feedback for professional growth

Prohibited Uses

You may not use our Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Upload malicious software or conduct cyber attacks
• Attempt to reverse engineer or copy our technology
• Use the Service for purposes other than real estate training
• Share or resell access to your account
• Create content that is offensive, inappropriate, or illegal

9. Intellectual Property

Our Rights

AvaSim and all related technologies, scenarios, avatars, coaching content, and software are owned by us or our licensors and are protected by intellectual property laws.

Your Rights

• You own your practice session recordings and personal data
• You grant us a license to use your practice data to improve our AI models
• You may use our Service according to these Terms during your subscription
• No ownership rights are transferred to you except as explicitly stated

Restrictions

• Do not copy, modify, or distribute our software or content
• Do not create derivative works based on our Service
• Do not use our trademarks without permission
• Do not attempt to extract or replicate our AI models

10. Privacy & Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Our total liability is limited to the amount you paid in the 12 months preceding the claim

13. Termination

Your Right to Terminate

• Cancel your subscription at any time through account settings
• Cancellation takes effect at the end of your current billing period
• You lose access to the Service and all accumulated minutes upon cancellation
• Download any personal data before cancellation if desired

Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay subscription fees when due
• Engage in fraudulent or illegal activities
• Cause technical or security issues
• Abuse our support systems or staff

Effect of Termination

• Immediate loss of access to the Service
• Forfeiture of all accumulated practice minutes
• Data deletion according to our Privacy Policy
• Survival of certain provisions (payment obligations, limitations of liability)

14. General Provisions

Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles.

Changes to Terms

• We may update these Terms to reflect changes in our Service or legal requirements
• Material changes will be communicated via email or in-app notification
• Continued use of the Service constitutes acceptance of updated Terms
• You should review these Terms periodically
